Workers' Compensation Insurance Guide

Workers' compensation provides medical benefits and wage replacement for employees injured on the job.

What It Is

Workers' compensation insurance provides statutory benefits to employees who suffer work-related injuries or illnesses. Benefits include medical treatment, wage replacement (typically 66.67% of average weekly wage), rehabilitation services, and death benefits. Workers' comp operates as a no-fault system — employees receive benefits regardless of who caused the injury, in exchange for waiving the right to sue the employer for negligence (the 'exclusive remedy' doctrine).

Who Needs It

Workers' compensation is mandatory in virtually every state for businesses with employees (with limited exceptions for very small employers in some states). Industries with high injury rates — construction, manufacturing, healthcare, and transportation — face the highest premiums and need proactive loss control programs to manage costs. Businesses using subcontractors must ensure proper workers' comp certificates to avoid assuming downstream liability.

How It Works

Premiums are based on payroll, industry classification codes, and experience modification rate (EMR). The EMR compares a company's actual losses to expected losses for its industry — an EMR above 1.0 indicates worse-than-average loss experience and results in higher premiums. Employers can manage costs through safety programs, return-to-work programs, claims management, and payroll/classification audits.

Limits & Deductibles

Workers' compensation provides statutory benefits with no policy limit on Part 1 (workers' comp benefits). Part 2 (employers' liability) typically provides $500K/$500K/$500K or $1M/$1M/$1M limits. Large employers may use large deductible, retrospective rating, or self-insured retention programs to reduce premiums while retaining more risk. Monopolistic state funds operate in a few states.

Claims Example

A warehouse employee suffered a back injury while lifting heavy boxes, requiring surgery and 6 months of rehabilitation. The workers' compensation policy covered $95K in medical expenses, $42K in temporary disability wage replacement, and $15K in vocational rehabilitation — ensuring the employee received proper care while protecting the employer from litigation.
